Terms of Service

Welcome to PopArt: Color Puzzle! These Terms of Service ("Terms") govern your use of the PopArt: Color Puzzle mobile application ("App") operated by KoanGames ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

2. Account

To access certain features of the App, you may need to sign in using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

The App, including all content, features, graphics, designs, sounds, and functionality, is owned by KoanGames and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

5. User Content

You retain ownership of any content you create within the App (such as completed puzzles and gallery artworks). By creating content in the App, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and store such content solely for the purpose of operating and improving the App.

6. In-App Purchases

The App may offer in-app purchases. All purchases are processed through the applicable platform (Google Play or Apple App Store) and are subject to that platform's payment terms. All purchases are final and non-refundable, except as required by applicable law or the platform's refund policy.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KOANGAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

10. Changes to These Terms

We may revise these Terms from time to time. The updated Terms will be posted on this page with a new "Effective Date." Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction of residence, without regard to conflict of law principles.
